In a significant legal development, the Office of the Special Prosecutor (OSP) has lodged a petition with Chief Justice Gertrude Torkornoo, urging the removal of Justice Edward Twum from overseeing the case pertaining to the confirmation application against the seizure and freezing of assets belonging to former Sanitation Minister, Cecilia Dapaah.
The OSP is poised to present its application for the court’s approval regarding the seizure of approximately 2.8 million cedis and 590,000 dollars, which were discovered in Cecilia Dapaah’s residence, as well as the freezing of her bank accounts. These actions were initiated due to suspicions that the assets may be tainted properties.
This petition comes on the heels of the court’s recent decision to grant a request by Cecilia Dapaah’s legal team to expedite the hearing date for the confirmation, which was initially slated for October 18.
However, lawyers representing the Office of the Special Prosecutor contend that Justice Edward Twum’s involvement in the case presents a prejudice against their side. The basis for this petition lies in the OSP’s belief that Justice Edward Twum exhibits a significant bias against both the OSP and the Special Prosecutor personally.
As a result, the OSP has made it unequivocally clear that they cannot, in good faith, participate in proceedings under the jurisdiction of Justice Edward Twum. This petition underscores the OSP’s commitment to ensuring a fair and impartial legal process in the case involving Cecilia Dapaah.
